Terms of service.
The contract between you and BYD Automotive Group when you use our website, buy or finance a vehicle, or participate in any of our programs.
Agreement
These Terms of Service (the "Terms") form a legally binding agreement between you and BYD Automotive Group Limited and its affiliates ("BYD", "we", "us") and govern your access to and use of our websites, mobile apps, in-vehicle software, retail stores, financing programs, and the BYD Giveaway.
By creating an account, placing an order, using the DiLink in-car system or entering the Giveaway, you accept these Terms. If you do not agree, do not use our services.
Eligibility
You must be at least 18 years old and legally able to enter a binding contract in your jurisdiction. Certain services — vehicle purchase, financing, investment — may impose higher age or residency requirements disclosed at enrollment.
We do not knowingly do business with persons on U.S. OFAC, EU, UK or comparable sanctions lists. If you are or become such a person, your account will be suspended and any pending order cancelled.
Account & security
- You are responsible for the accuracy of information you provide and for keeping it up to date.
- You must protect your account credentials. We recommend enabling multi-factor authentication.
- You are liable for activity under your account unless you notify us promptly of unauthorized access.
- We may suspend or terminate an account for suspected fraud, sanctions concerns, abusive behavior toward staff, or material breach of these Terms.
Orders & pricing
Displayed prices are inclusive of applicable taxes only where stated. Dealer-delivered vehicles may carry additional fees set by the dealer. Your contract of sale — not the website — is the authoritative record of price, options and delivery date.
A reservation holds build capacity but does not complete a sale. A confirmed order is created only when we countersign your contract and charge your deposit. We may reject an order in cases of pricing error, stock unavailability or failed compliance screening.

Delivery & risk
Delivery windows are estimates. Risk of loss passes to you on signed delivery acceptance. Title passes on receipt of cleared funds. Home delivery, concierge hand-off and store pickup are available where offered.
Report exterior damage before signing. After acceptance, cosmetic claims follow the warranty process.
Warranty
Every new BYD sold through an authorized channel carries:
- Basic vehicle warranty — 4 years / 100,000 km;
- Powertrain warranty — 8 years / 200,000 km;
- High-voltage battery warranty — 8 years / 200,000 km, 70% capacity retention;
- Corrosion warranty — 12 years, perforation-only;
- Consumables — not covered (brake pads, tires, wiper blades).
Warranty work must be performed at a BYD-authorized service center. Unauthorized modifications to the high-voltage system void the battery warranty. Full terms and regional variations are in the vehicle-specific warranty booklet.
Acceptable use
You agree not to:
- reverse-engineer, decompile or tamper with DiLink software except as permitted by law;
- disable, bypass or alter safety-critical vehicle systems;
- use our services to transmit malware or conduct security testing without written authorization;
- resell commercial quantities of vehicles without a BYD distribution agreement;
- use the BYD name, logo or vehicle imagery in a manner that implies endorsement without permission.
Financial services
BYD Installments, BYD Pooled Funds, BYD Stocks (brokerage), and BYD Giveaway are offered by regulated subsidiaries identified at bydautomotivegroup.com/legal/entities. Eligibility, suitability, fees and risk disclosures are in the product-specific agreements you sign at enrollment.
Giveaway & promotions
The BYD Giveaway is a sweepstakes governed by Official Rules published at byd.com/giveaway/rules, including jurisdictional eligibility (void where prohibited), odds of winning, alternative means of entry (AMOE), and winner-selection methodology.
No purchase is necessary to enter or win. Purchase does not improve your odds. The Rules control in the event of conflict with marketing materials.
Intellectual property
All content on our websites — text, images, logos, software, vehicle designs — is owned by BYD or licensed to us. You receive a limited, non-exclusive, revocable license to use the services for personal, non-commercial purposes.
"BYD", "Blade Battery", "DiLink", "DiPilot", "DM-i", "Denza", "Yangwang" and the BYD logo are trademarks of BYD Company Limited, registered in multiple jurisdictions.
Disclaimers
Except for express warranties stated in §6 and product-specific agreements, our services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all other warranties, whether express, implied or statutory, including merchantability, fitness for a particular purpose and non-infringement.
Driver-assistance systems (DiPilot, adaptive cruise, lane centering) are assistance systems — not self-driving. The driver remains responsible for operating the vehicle at all times.
Liability
To the extent permitted by law, neither party is liable for indirect, incidental, consequential, special or exemplary damages. Our total aggregate liability under these Terms is capped at the greater of (a) fees you paid us in the twelve months preceding the claim, or (b) USD $1,000.
Nothing in these Terms limits liability that cannot be limited by law — including fraud, gross negligence, death or personal injury caused by our negligence, or your statutory consumer rights.
Dispute resolution
Before filing any claim, both parties will attempt informal resolution for 60 days from the written notice. If unresolved:
- Consumers may take disputes to the courts of their place of residence or a competent consumer-dispute body.
- Non-consumers agree to final and binding arbitration under the rules of the HKIAC, seated in Hong Kong, conducted in English, before a single arbitrator.
- Class actions are waived except where prohibited by applicable law.
Governing law
These Terms are governed by the laws of:
- Hong Kong SAR, excluding conflict-of-laws rules, for non-consumer users;
- your country of habitual residence for consumer users, where local law mandates that result.
Changes & notices
We may update these Terms. Material changes take effect 30 days after we post the updated version and notify account holders by email. Continued use after the effective date is acceptance.
